恶意透支型信用卡诈骗案件适用最新司法解释的解析

摘　　要：两高2018年12月1日实施的《关于修改<关于办理妨害信用卡管理刑事案件具体应用法律若干问题的解释>的决定》,针对当前恶意透支型信用卡诈骗罪法律适用中存在的突出问题,对原解释进行修改,凸显恶意透支“以非法占有为目的”独立要件地位,强调对“非法占有目的”的综合考量,并允许提出反证。明确恶意透支催收的有效性,强调必须同时满足“有效催收”的实体条件和证据条件,进一步规范了入罪标准。大幅提高定罪量刑的数额标准,完善恶意透支数额的计算方法,确立从宽处理规则,符合宽严相济刑事政策。With the rapid development of the credit cards industry,the risk in this field has become a prominent issue and consequently the crimes of credit cards are also on the rise.Furthermore as an emerging market for credit cards,such kind of crimes disturbs the administration of credit cards,affect the development of our credit cards industry and impair the safety of the credit-card holders’property.Relevant provisions on the crimes of credit cards have been stipulated in Criminal Law of the People’s Republic of China and in Amendment to the Criminal Law of the People’s Republic of China.From December 1,2018,further amendments and supplements have been made based on the former legislation in Interpretation of the Supreme People’s Court and the Supreme People’s Procuratorate of Several Issues concerning the Specific Application of Law in the Handling of Cases of Crimes Disturbing the Administration of Credit Cards.The above-mentioned legislation on credit cards has provided a comprehensive guiding for our legal practice.
