摘　　要：公诉权由检察机关行使意味着附条件不起诉的考察权应赋予检察机关,而以检察机关法律监督下的NGO负责适用附条件不起诉的未成年犯罪嫌疑人的日常考察帮教工作,既可以充分发挥NGO的专业人才优势,又可以避免“多头负责”的弊端。基于降低未成年犯罪嫌疑人的人身危险性和促使其改过自新的立法宗旨,检察机关有权根据其在考验期的表现,适时地在法定幅度内延长和缩减考验期。附条件不起诉的帮教工作绝不是独断的、教条的或家长式的灌输,而是引导未成年犯罪嫌疑人对自己的欲望信念作出反思评估;更是通过某些优秀人物的示范作用,在他们内心产生某种道德感动,进而启迪他们的心灵。The examination right of conditional non-prosecution shall be exercised by the procuratorial organ,which is an inevitable requirement for the procuratorial organ to exercise the right of public prosecution.The NGO under the legal supervision of the procuratorate is responsible for the daily inspection and assistance of the juvenile criminal suspects who are not subject to the conditions.It can not only give full play to the advantages of NGO,but also avoid the drawbacks of“long-term responsibility”.Based on the legislative purpose of reducing the personal risk of juvenile criminal suspects and promoting their rejuvenation,the procuratorate has the right to extend and reduce the test period within the statutory range according to its performance during the test period.The teaching and non-prosecution work is not an arbitrary,dogmatic or paternalistic indoctrination.Our purpose is to guide juvenile criminal suspects to reflect on their own beliefs and desires.Moreover,hopefully,they can be moved and enlightened by the good examples of some outstanding people.
