摘　　要：在对部分海事案件裁判文书进行实证分析的基础上可以看出,海事案件电子数据证据真实性认证中存在错误使用佐证规则、过于依赖公证的作用、未充分说明理由等问题。分析问题原因后,提出正确的路径为深入了解海事案件电子数据证据尤其是海事特有电子证据,掌握关于电子数据证据的特别规定,正确指引当事人举证、质证,结合证据特点和特别规定进行真实性认证。最后列举部分海事特有电子证据用以上路径进行真实性认证,在对具体证据认证时应当结合证据特点,适用不同的标准。On the basis of the analysis of some judgments of maritime cases,it is found there are mistakes in authenticating electronic data evidence in maritime cases,such as wrongly usage of rule of being supported by other evidences,depending unduly on notarization,and explaining the reason inadequately.Based on the analysis of the causes of these problems,the authors believe the proper approach is to have some insight into maritime electronic data evidence,know the specific provisions of electronic data evidence well,inform the parties concerned of the requirements for producing evidences and cross-examinations,and verify the genuineness in accordance with the characteristics and specific provisions of the electronic data evidence.Instances are cited to illustrate the above-mentioned solution which is to apply different standards according to the characteristics of evidence.
