摘  要:担保物权作为重要的物权类型近年来有不断发展繁荣的态势,而担保物权包含的种概念担保物权之间在民事活动中竞合存在时的效力次序问题却一直未能得到解决。这种尴尬混乱的局面给民事担保活动的发展带来了诸多障碍,也是担保物权理论研究应当注意的问题。通过对不同担保物权效力属性的研究表明,同种担保物权竞合时的优先次序问题,需要依赖物权变动登记制度的完善来解决。三种担保物权中,留置权一般情况下具有绝对优先性,但在特定情形下,为各方权益之平衡,应予减让;抵押权和质押权依其形成时间先后和公示方法的不同,其优先次序需具体分析。As an important type of real right,the real right of guarantee has been developing and prospering in recent years. However,the issue of the order of validity of the concept of real right of guarantee has not been solved. This awkward and chaotic situation has brought many obstacles to the development of civil guarantee activities,which is also a problem that should be paid attention to in the theoretical study of real right of guarantee. According to the study of different validity properties of real rights of guarantee,the priority of the same real rights of guarantee should be solved by improving the registration system of real rights change. Among the three types of security property rights,the lien is generally of absolute priority,but under certain circumstances,it should be reduced to balance the interests of all parties. The priority of mortgage right and pledge right should be analyzed in detail according to the different formation time sequence and public way.
