摘　　要：《公安机关办理行政案件程序规定》第36条第3款新增了公安行政法律文书的电子送达内容,这契合了电子政务迅猛发展的现实需求。因该条款规定内容的笼统性和模糊性,公安机关采取电子送达,应当适用《民事诉讼法》的相关规定。受送达人的同意是电子送达必备的主观要件,在此基础上,电子送达可以成为公安行政法律文书优先的文书送达方式。但基于对行政相对人权益的特别保障,并非所有的公安行政法律文书均可电子送达,另外,电话送达作为电子送达的例外方式应当谨慎采取。我国电子送达的成功采用到达主义标准,这要求公安机关应当积极采取措施,固定送达日期。电子送达的日渐普遍,也对公安信息化建设提出更高要求。The paragraph 3 of the article 36 of the Procedure Spree for the Handling of Administrative Cases by Public Security Organs adds the content of electronic delivery of public security administrative legal instruments,which is in line with the realistic needs of the rapid development of e-government. Because of the generality and ambiguity of the contents of this provision,the public security organs shall apply the relevant provisions of the Civil Procedure Law when they take electronic delivery. The consent of the person served is the subjective element necessary for electronic service,on the basis of which electronic service can become a priority instrument service mode of public security administrative legal instrument. However,based on special protection of the rights and interests of administrative counterparts,not all public security administrative legal instruments can be delivered electronically,in addition,telephone delivery as an exception to electronic delivery should be taken with caution. The success of electronic delivery in China adopts the arrival standard,which requires the public security organs to take active measures to fix the delivery date. The increasing popularity of electronic delivery also puts forward higher requirements for the construction of public security informationization.
