文化遗产权视角下我国文化遗产行政执法研究

摘　　要：文化遗产行政执法是文化遗产法律保护的重要手段之一。然而,当前我国文化遗产行政执法存在很多问题,如过度强调私权理念和刑事手段,文化遗产行政执法没有得到应有的重视;执法主体分布不均,文化遗产行政执法效能较低;违法活动日趋隐蔽、复杂,增加了文化遗产执法的难度;监督机制不健全导致文化遗产执法存在漏洞;忽视文化遗产内在规律导致文化遗产保护性破坏频发。对此,应当分别从提高文化遗产行政执法的合法性、重新认识并充分利用行政执法对文化遗产保护的特有价值、平衡文化遗产行政执法主体的配置、预防保护性破坏与提高执法能力并举、完善对文化遗产行政执法的综合监督机制等方面对我国文化遗产行政执法予以完善。Administrative enforcement of the law is one of the important means to protect the cultural heritage.However,there are many problems in the administrative enforcement of the law of cultural heritage in China.For example,over-emphasizing on private rights and criminal means;lacking of the due attention to the administrative enforcement of law of cultural heritage;uneven distribution of enforcement subjects;the low efficiency of administrative enforcement;increasingly concealed and complex illegal activities;the increasing of the difficulties of administrative enforcement;imperfect supervision mechanism caused loopholes in administrative enforcement;neglecting of inherent rules of cultural heritage leaded to frequent protective damage to cultural heritage.Based on problems listed above,it is necessary to increase the legitimacy of the administrative enforcement of cultural heritage,re-understand and fully use the special value of administrative enforcement of law in protecting cultural heritage,balance the allocation of the subjects of administrative enforcement,emphasize on both preventing protective damage and improving enforcement ability,and improve the comprehensive supervision mechanism to illegal law-enforcement activities.
