摘　　要：研究目的:探讨宅基地“三权分置”改革的法律表达与法律构建。研究方法:文献资料分析、综合分析法。研究结果:宅基地“三权分置”是中国农村发展到特定历史阶段后宅基地权利体系的新变革,政策层面与法律层面含义的不同彰显了形式理性与实质理性的对立统一;法律含义和法律结构依赖于分置模式的选择,总体上形成“宅基地所有权—宅基地使用权—宅基地利用权”的权利架构。研究结论:“三权分置”的关键是宅基地利用权的法律构建,焦点是资格权的法律翻译,需要在法律上设计出既满足法律形式理性之要求,又契合当下中国之实质理性的宅基地“三权分置”。The purpose of this paper is to explore the legal expression and legal construction of the reform of tripartite entitlement system of rural residential land.The research methods includes literature analysis and comprehensive analysis.The results show that:tripartite entitlement system of rural residential land is a new change in the right system of rural residential land when the development of rural areas reaches a specific historical stage in China.The different meanings of policy and law layers highlight the unity of opposites between formal rationality and substantive rationality.The meaning and structure of law depend on the choice of division mode.In general,the right structure of“rural residential land ownership-rural residential land use right-rural residential land alienation right”has been formed.In conclusions,the key to tripartite entitlement system of rural residential land is the legal construction of the new right to alienate,focusing on the legal translation of the right of qualification.It is necessary to design a legal tripartite entitlement system of rural residential land,which not only meets the requirements for legal formal rationality,but also conforms to the substantive rationality of China at present.
