摘 要:现代服装早已远远超越了遮体御寒的基本作用,其功能已经延伸到社会、文化和精神领域。服装设计已发展成为一门综合类艺术,是设计师运用各种工艺元素、手工技艺,以色彩、图案、形状组合形成的具有美感和个性的产物,其过程体现了设计师的独特创意和个性风格表达,是智慧创造的结晶。服装设计的成果是具有审美价值的艺术品,更是能为企业带来高额回报的知识产品。我国作为服装生产大国,保护原创服装设计,激励创新投入,对繁荣我国的服装设计产业大有裨益。世界上包括美国和欧盟在内的许多国家对服装设计都给予知识产权保护,理论发展和保护模式各有千秋。我国对服装设计的保护主要根据现行的著作权法、专利法和商标法等进行,多种保护模式和路径各有利弊、互有交叉。本文拟对服装设计的中外立法和保护模式予以比较分析,并结合近期热点案例进行探讨。In modern times,the function of clothing has extended far beyond keeping people warm to the social,cultural and spiritual areas.Fashion design has developed into a kind of comprehensive art.Designers use various elements of craftsmanship and manual skills to form beautiful and individual creations which are composed of different colors,patterns and shapes.The whole process reflects designers’unique creativity and personal expression,which crystalizes their wisdom.The works of fashion design are not only work of arts with aesthetic value but also intellectual products that can bring high profits to enterprises.As a large country of garment production,China can benefit immensely from protecting original fashion design,encouraging investment in innovation to further prosper the domestic fashion design industry.Fashion design enjoys intellectual protection worldwide,different countries provide different theoretical and practical protection modes for it.China mainly protects fashion design according to Copyright Law,Patent Law,and Trademark Law.Each protection mode has its own pros and cons.The paper carries out a comparative analysis of the legislation and protection modes of fashion design in China and foreign countries and discusses the relevant hot cases in this field.
