摘 要:以审判为中心的司法改革大多集中在审判及监察制度方面,未涉及从整个刑事诉讼纵向构造的角度对审前程序中的强制措施进行事前检察控制。加强检察机关对强制措施的检察控制成为理论界和实务界重点关注的问题。深入研究域外对审前程序的司法审查制度,结合我国具体情况,以重构强制措施基础理论范畴为前提,建立健全检察机关对强制措施的法律监督职能及强制措施备案制度,实现强制措施决定权与执行权相分离。同时,还必须完善以程序性权利为中心的救济机制。The judicial reform of taking trial as the center mostly focuses on the trial and supervision system,and does not involve pre-trial judicial control of compulsory measures in the pre-trial procedure from the perspective of the vertical structure of the whole criminal procedure.Strengthening the judicial control of the procuratorial organs over compulsory measures has become the concern from both theoretical and practical circles.We should study the judicial review system of the pretrial procedure in depth,establish and improve the legal supervision function of the procuratorial organs over compulsory measures and the filing system of compulsory measures by taking the reconstruction of the basic theoretical category of compulsory measures as the premise in accordance with China′s specific situation so as to realize the separation of the decision-making power of compulsory measures from the enforcement power.At same time,it is necessary to improve the relief mechanism centered on procedural rights.
