摘　　要：医药创新是药企提高竞争力的源泉,创新的健康发展需要有力的知识产权等措施保驾护航。分析目前药企知识产权现状主要表现在:中小药企重产销轻研发,做仿制药或代加工,部分药企知识产权有量欠质且缺少战略布局,中药方面的创新优势也受到国外竞争者的强大威胁,只有少数药企的知识产权保护意识较强措施也较实。面对这一现实,宜采取针对性的对策有:强化医药知识产权管理体系建设有力支撑知识产权布局,以先进的技术手段和理念做好医药知识产权规划的落实,打好医药知识产权组合拳使知识产权保护有效有力,坚守中药创新优势,不断迈向中西医从结合到融合的高端,加强知识产权的法务工作,变事后补救为事先防范,为医药创新主动作为有效护航。Medical innovation is the source of the pharmaceutical enterprises to improve their competitiveness.The healthy development of innovation requires strong intellectual property rights and other measures.The analysis of the current situation of intellectual property rights of pharmaceutical enterprises mainly shows that small and medium-sized pharmaceutical enterprises attach importance to production and sales and neglect research and development.To do generic drugs or processing,the intellectual property rights of some pharmaceutical companies are not qualitative and lack strategic layout.The innovative advantages of traditional Chinese medicine are also threatened by foreign competitors.Only a few pharmaceutical enterprises have stronger awareness of intellectual property protection.In the face of this reality,the countermeasures should be taken as follows:strengthening the construction of intellectual property management system of medicine,supporting the distribution of intellectual property right,implementing the plan of medical intellectual property with advanced technical means and ideas,making a good combination of intellectual property rights and intellectual property rights and protecting the advantages of intellectual property rights and adhering to the innovative advantages of traditional Chinese medicine.We continue to move towards the high end of the integration of traditional Chinese and Western medicine,strengthen the legal work of intellectual property,change the remedy after the event as a precaution,and take the initiative as an effective escort for the medical innovation.
