摘  要:宅基地"三权分置"并不是孤立的当代问题,应该放在新中国成立70年土地政策变革的背景下讨论。当下的改革是针对违背"一户一宅"原则和宅基地及农村房屋闲置现象的整治,应进一步区分进城落户和非进城落户两种情况。宅基地权利分不分置的前提是考察是否满足分配正义,在此基础上才可以分析地上房屋的利用效率问题。宅基地上房屋的所有权一旦向本集体经济组织以外的人转移,则宅基地的分配目的将无法实现。因此,闲置农房财产权流转的主要实现方式应是租赁。Rural homestead "Separation of Three Rights" is not an isolated contemporary issue, which shall be discussed under the background of 70 years’ land policy reformation since the establishment of the People’s Republic of China. Current reform is to regulate those breaking the rule of "one household one homestead" and leaving homestead or house unused, but this shall be treated respectively for famers having got urban household register and those not. The precondition for whether separating homestead rights or not is to examine if distributive justice having been satisfied and then shall be issue of house use efficiency be considered. If ownership of the house on homestead is transferred to a person outside the collective economic organization, the purpose of homestead distributive justice will not be fulfilled. Therefore, it is lease that shall be the main means of implementing the property function of the rural house leaving unused.
