公安机关适用认罪认罚从宽制度的现状及完善措施——以北京试点工作为例

摘　　要：为贯彻党的十八届四中全会明确提出的“完善刑事诉讼中认罪认罚从宽制度”要求,全国十八个试点城市开始适用认罪认罚从宽制度。北京市公安局在适用该制度的探索中建立了一套符合自身工作实际的机制,在取得初步成效的同时也暴露出一些问题。针对存在的问题,提出关于认罪认罚从宽制度在公安机关适用的具体完善措施:明确公安机关适用认罪认罚从宽制度的正当性,赋予公安机关实体权力,加强认罪认罚从宽制度的系统建设。In order to implement the requirements of“improving the leniency system of guilty plea and accepting punishment in criminal proceedings”put forward by the Fourth Plenary Session of the 18th CPC Central Committee,the leniency system of confession and punishment has been applied in 18 pilot cities nationwide.Beijing Municipal Public Security Bureau has established a set of mechanism in line with its own work practice in the exploration of the applicable system,which has achieved initial results and exposed some problems at the same time.In view of the existing problems,this study puts forward some specific measures to improve the application of leniency of confession and punishment in public security organs.They are to clarify the legitimacy of the application of leniency of confession and punishment in public security organs,to give them substantive power,and to strengthen the system construction of leniency of confession and punishment.
