证据审查视域下侦查辨认规范化的思考

摘　　要：侦查辨认具有科学性和局限性,规范侦查辨认的程序,能维护侦查辨认笔录的证据效力。侦查辨认的启动应根据侦查所处的"知道犯罪嫌疑人阶段"和"不知道犯罪嫌疑人阶段"两个阶段而采取不同的措施。在"不知道犯罪嫌疑人阶段",侦查辨认的启动具有任意性;在"知道犯罪嫌疑人阶段"应提请侦查辨认。侦查辨认的时间和地点是证据审查的重点,应注意完善侦查辨认的相关手续。侦查辨认的组织者应为专门的非承办案件的侦查人员,并实施侦辨分离制度。建议侦查辨认采取排斥见证人的制度,并严格执行证据审查制度,以维护侦查辨认的公正合法。Investigation identification is scientific and limited,and the procedures for investigation identification are able to maintain the effectiveness of evidence for investigation and identification.The initiation of investigation and identification shall be carried out according to the two stages of"the stage of knowing the suspect"and"the stage of not knowing the suspect".In the"not knowing the stage of criminal suspects",the initiation of investigation and identification is arbitrary;in the"knowing the stage of suspects",it should be investigated and identified.The time and place of investigation and identification are the focus of evidence review,and attention should be paid to improving the relevant procedures for investigation and identification.The organizer of the investigation and identification shall be a special investigator of the non-contracted case and implement a system of detection and separation.It is recommended that the investigation identify the adoption of the system of exclusion of witnesses and strictly enforce the evidence review system to maintain the fairness and legality of investigation and identification.
