摘  要:当下我国的土地利用规划权在实践的运行中引发了诸多的利益冲突和纠纷,就其根源而言,主要在于这一权力的配置和运行过于刚性,难以顺应当下市场经济迅速发展的诉求,难以较为妥当地协调好多元主体之间的利益诉求,因而亟需面向市场经济发展的现实进行理性化改革。实践表明,创设土地发展权,并赋予其市场化的可流转性乃是纠偏这一弊端,增强我国现行土地利用规划权的灵活性、实现其弹性化运作目标的理性选择。创设土地发展权来优化和完善我国现行土地利用规划权的配置和运行,亦就亟需在法理上回答土地发展权与土地利用规划权二者之间的关系应如何定位这一中心命题。从形式上看,土地发展权与土地利用规划权属于两项不同性质的权利,但就实质层面而言,二者之间具有内在的关联性和统一性,即,土地发展权是土地利用规划权行使的法理依据;土地利用规划权是土地发展权创设和运行的技术保障;土地发展权的流转是优化土地利用规划权的应然诉求。对此,我国法在引入土地发展权时,亟需处理好二者之间的关系。At present,China's land use planning right has caused many conflicts of interest and disputes in the practice.In terms of its roots,it mainly lies in the fact that the allocation and operation of this power is too rigid,and it is difficult to comply with the rapid development of the market economy.It is difficult to properly coordinate the interests of multiple entities,so it is urgent to carry out rational reforms in the face of the reality of market economy development.Practice has shown that creating land development rights and giving them market-oriented traversability is the drawback of correcting the disadvantages,enhancing the flexibility of China's current land planning rights and achieving its flexible operational goals.Creating land development rights to optimize and improve the allocation and operation of China's current land planning rights,it is also necessary to legally answer the central proposition of how the relationship between land development rights and land planning rights should be located.Formally speaking,land development rights and land planning rights belong to two different natures of rights,but in terms of substantive aspects,the two have inherent relevance and unity,that is,land development rights are the exercise of land use planning rights.The legal basis of the law.the exercise of the land use planning right is the technical guarantee of the land development right.the transfer of the land development right is the response to the optimization of the land use planning right.
