法院撤销仲裁调解书的实证分析——以42个案例为样本

摘　　要：通过对法院审理撤销仲裁调解书案件所作的42份裁定书的实证研究表明,对于是否有权审理撤销调解书案件,各地法院之间甚至上下级法院之间存在着立场冲突。对于撤销的法律依据和事由,所有持肯定观点的法院采纳的都是参照《仲裁法》关于仲裁裁决撤销的规定。理论上,撤销仲裁调解书制度有存在的合理性和必要性;司法实践中,因法院不受理撤销仲裁调解书而导致当事人合法权益受损的案件时有发生。从应然的角度来看,撤销仲裁调解书制度的确立是必要的,但是,参照裁决撤销规定的方式存在天然的缺陷。从长远看,应当在《仲裁法》修订时增加设立单独的仲裁调解书撤销制度,基于实践中的情况,根据仲裁调解书的特点设置适合于调解书的撤销事由。Through the empirical study of 42 decisions made by courts with regard to setting aside the conciliation statements,it shows that there is a position conflict as to whether they have the right to hear the case of setting aside conciliation statement between the courts of different regions or even between the upper and lower courts.As for the legal basis and reasons for the setting aside,all courts taking positive views adopt the means of referring to the provisions on setting aside arbitral awards in the Arbitration Law.In theory,the system of setting aside conciliation statement has its rationality and necessity.In judicial practice,the situations that the legal rights and interests of the parties are damaged because of the court’s refusal of jurisdiction on the application for setting aside conciliation statement occur occasionally.From the perspective of necessity,it is necessary to establish the system of setting aside conciliation statement.However,there are inherent defects in the way of reference to the provision of setting aside award.In the long run,a separate setting aside system of conciliation statement should be set up when the Arbitration Law is revised.Based on the situation in practice,according to the characteristics of the arbitration conciliation statement,we should set up the cancellation reasons suitable for the conciliation statement.
