三权分置下农地经营权抵押融资运行机理——基于扎根理论的多案例研究

摘　　要：本文选取江苏泗洪县、山东寿光市、辽宁昌图县、宁夏同心县四个国家级农地经营权抵押融资试点县市为案例,运用质性研究的扎根理论方法,探讨了三权分置背景下农地经营权抵押融资的运行机理。研究发现:在典范模型所涉及到的范畴中,地方政府承担“拓荒成本”、“差别匹配”的农地抵押契约治理结构、受“经营权继受取得”与否直接影响的农地抵押价值、适用于“农地薄市场”的组合抵押担保方式等4个核心范畴是影响农地经营权抵押融资的关键因素。农地经营权抵押融资市场的锁定状态得以解除后,政府应当在减少契约的交易费用方面继续发挥作用。同时,三权分置下农地经营权抵押融资试点做法的推行,需要充分考虑地区的经济发展状况、人均耕地面积及农业产业结构等因素,因地制宜地借鉴试点地区模式。This article selects Sihong County of Jiangsu Province,Shouguang City of Shandong Province,Changtu County of Liaoning Province and Tongxin County of Ningxia Province as the cases,and uses the grounded theory methodology to explore the operation mechanism of mortgage financing of farmland management rights under the background of division of three kinds of rights.The study finds that among the categories involved in the model,four core categories,namely,the governance structure of farmland mortgage contract of“pioneering cost”undertaken by local governments,the governance structure of farmland mortgage contract of“differential matching”,the value of farmland mortgage directly affected by“derivative acquisition of management rights”,and the combined mortgage guarantee mode applicable to“thin market of farmland”,are the key factors that affect the mortgage financing of farmland management rights.Therefore,it is proposed that after the lock-in status of the mortgage financing market of farmland management rights is released,the government should continue to play a role in reducing the transaction costs of the contract.Besides,the implementation of pilot practices of mortgage financing of farmland management rights under the division of three kinds of rights should fully consider the level of regional economic development,per capita cultivated land,the structure of agricultural industry and other factors,and draw lessons from pilot practices based on local conditions.
