环境犯罪刑事立案监督问题研究

摘　　要：按照最高人民检察院“两个专项立案监督活动”(破坏环境资源犯罪专项立案监督活动和危害食品药品安全犯罪专项立案监督活动)的部署,北京市检察机关建议行政执法机关移送、监督公安机关立案侦查了一批涉嫌环境污染犯罪案件。实践中环境犯罪案件仍面临案件少、移送难、立案难等困境。文章以北京市环境犯罪案件为样本,研究本市环境犯罪刑事立案监督概况,分析环境犯罪刑事案件立案监督工作面临立法层面、法律适用层面的问题及原因,并提出完善环境犯罪刑事立案监督的路径。According to the deployment of the“two special project supervision activities”of the Supreme People’s Procuratorate(special case supervision activities for crimes against environmental resources crimes and special case supervision activities for food and drug safety crimes),the procuratorial organs in Beijing suggested that the administrative law enforcement organs transfer and supervise the public security organs to file and investigate a number of suspected environmental pollution crimes.In practice,environmental crime cases still face difficulties such as fewer cases,difficulty in transferring,and difficulty in filing a case.The article takes Beijing environmental crime cases as a sample to study the supervision of criminal cases of environmental crimes in this city,analyzes the criminal supervision of environmental crimes and the problems and reasons at the legal application level,and propose ways to improve the criminal case supervision of environmental crimes.
