摘　　要：战时缓刑作为军事刑罚的一项重要内容,自古以来被广为运用。为规范这一制度实施,新中国于1981年正式建立了战时缓刑制度。但至今为止,战时缓刑的司法适用并无明确法律规定,且理论界对相关问题亦存在争议。战时缓刑的启动应以犯罪军人同意为基础、本人或所在单位申请为必要条件,军事司法审查不以军事行政审查同意为前提,并应明确限制适用条件。战时缓刑以一审终审为宜,根据不同情况采取不同方式公开宣告。采“孰短”原则确定战时缓刑考验期间,在考验期内,基于其军人身份正常发放薪资,但应取消福利奖励,并在军队保卫部门监督下由犯罪军人所在基层单位实施考察,考验期满根据不同情况进行执行变更。As an important part of military penalty,wartime probation has been widely used since the ancient times.In order to standardize it,we formally established a system of wartime probation in 1981.However,up to now,there haven’t been clear legal provisions on the judicial application of wartime probation,and there also have been disputes on related issues in the theoretical circles.The start of wartime probation should be based on the consent of the criminal serviceman,and the application of himself or his unit is necessary.The military judicial review should not be based on the consent of the military administrative review,and the application conditions should be restricted clearly.The first instance-final trial is suited better and the public announcement should made in different ways according to different situations.The principle of“which is shorter”is adopted to determine the test period of wartime probation.During the probation period,servicemen shall be paid normally according to their military status,but,there welfare shall be cancelled,and criminal servicemen’s grass-roots units are supposed to inspect it under the supervision of the military security department.After the expiration of probation,changes should be carried out according to different situations.
