网络首发著作权的民法救济和行政法救济

摘　　要：网络首发适应互联网的特点,促进了知识的迅速转化。网络首发著作权主要是作者的著作权,也包括期刊出版者和网络出版者著作权的邻接权。网络首发著作权是一种特殊的著作权,有一定的范围和内容,其民法救济和行政法救济成为网络首发著作权法律保护的起点,法律责任形式灵活多样。侵害网络首发著作权的法律救济主要是民事救济,行政救济也发挥了一定的作用。The first launch of Internet copyright satisfies the need of the times and promotes the rapid transformation of knowledge.The first Internet copyright mainly refers to the author’s copyright,and also includes the adjacent right of the journal publisher and the Internet publisher’s copyright.As a kind of special copyright with certain scope and content,its civil law remedy and administrative remedy become the legal boundary of the first Internet copyright protection.The legal remedy for infringing the first copyright of Internet is mainly civil remedy while administrative remedy also plays a certain role.
