白酒行业产品证明标志法律保护体系的研究

摘　　要：白酒产品商标是企业的无形资产,其中蕴含着极高的商业价值和企业信誉,因此本文针对白酒行业产品证明标志法律保护体系进行研究。经分析,将当前白酒行业标志法律保护体系存在的不足划分为:白酒行业产品商标的立法比较滞后,且针对商标侵权的惩治力度不够;执法监管相对滞后;白酒产品企业整体法律意识急需加强三方面。针对当前相关法律体系存在的不足,依据在先权原则、公平竞争原则、避免商业标识淡化原则提出完善建议。所提建议内容主要包含一般条款完善、例外条款的设置、相应法律责任条款的完善三方面。一般条款完善中强调了对于不正当竞争的行为外延范围进行扩充和扩大一般条款整体适用范围。例外条款的设置中包含通用名称与常用标识科学管理和使用、商标在先使用、白酒产品外观和功能正常显示。相应法律责任条款的完善中包含民事法律责任的承担和确定损害赔偿范围。通过上述分析为我国白酒行业产品商标法律保护提出合理化建议,促进白酒行业的有序发展。Trademarks are intangible enterprise assets containing high commercial values and enterprise reputation.Therefore,the legal protection system of trademarks in Baijiu industry was studied.The analysis indicated that,the shortcomings of legal protection system at present included the lagged legislation on trademark,the backward corresponding law enforcement and supervision,and the lack of sufficient punishment measures.In view of these shortcomings,based on the principles of priority right,fair competition and full consciousness of commercial marks,some suggestions were put forward in three aspects including the improvement of general clauses,the setting of exception clauses,and the improvement of corresponding legal liability clauses.These suggestions might be helpful for advancing the orderly development of Baijiu industry.
