摘 要:法律援助工作是中国特色社会主义法治体系的重要组成部分。我国现有的法律援助存在法律援助律师数量不足、具有资格证书的工作人员较少、从业人员素质不高的问题。选人机制不合理、用人机制不科学、留人机制不完善是造成这一现状的主要原因。近年来国家相继出台一系列政策完善法律援助的发展,但制度性和结构性的问题尚未触及。从人力资源改革路径的角度来看,法律援助人力资源改革应以“知人善任”为导向,从保障律师成为中坚力量、依托高校进行人才储备、促进公众参与的角度出发优化法律援助机构选人机制;以“人岗合一”为途径,形成以公职律师为主、社会律师为辅的用人机制;以“人尽其才”为目的,不断优化法律援助机构人力资源配置、培训和激励机制的建设。Legal aid is an important part of the establishment of the socialist legal system with Chinese characteristics.There are some problems in the current legal aid in China,such as the insufficient number of legal aid lawyers,the small number of staff with qualification certificate,and the low quality of legal aid practitioners.The main reasons for this situation are the unreasonable selection mechanism,the unscientific employment mechanism and the imperfect retention system.In recent years,the state has issued a series of policies to improve the development of legal aid,but the institutional and structural problems have not been touched.From the perspective of human resources reform path,the reform of human resources in legal aid should be guided by“knowing people and being good at their duties”,optimize the selection mechanism of legal aid institutions from the perspective of ensuring lawyers to be the backbone,relying on universities to carry out talent reserve and promoting public participation;form the employment mechanism with public lawyers as the main part and social lawyers as the auxiliary part through the way of“integration of people and posts”;to optimize the allocation of human resources,training system and incentive mechanism of legal aid institutions for the purpose of“making the best of people’s talents”.
