论政府在科研诚信管理中的查处责任

摘　　要：近年来我国科研诚信问题频发,党和国家高度重视,发文要求完善科研诚信建设,严肃查处违背科研诚信要求的行为,并将科研单位确定为查处的第一责任主体。这一规定并无法律上的依据,规避了政府的法定职责,影响了查处的效果,导致被处理人权利救济不充分。科研诚信管理应当坚持科研单位学术自治与政府监管相结合原则,由政府依法承担多层次责任,对其中属于自身依法履职的事项负有直接查处的责任;对于此外的事项,负有自行查处的责任;对所有违背科研诚信要求的行为负有监督查处的责任。In recent years, the problem of research integrity has been exposed frequently in China, and the Communist Party of China and the state attach great importance to it. The paper calls for improving strengthening the construction of research integrity, seriously investigating and punishing acts that violate the requirements of research integrity, and identifying scientific research institutions as the first subject of responsibility for investigation and punishment. This provision has no legal basis, evades the government’s statutory responsibilities, and affects the effect of investigation and punishment, and leads to inadequate remedies for the rights of the investigated. The management of research integrity should adhere to the principle of combining academic autonomy of scientific research institutions with government supervision, and the government should assume multi-level responsibilities according to law, and directly investigate and punish the matters that belong to its own legal performance;for other matters, it should be responsible for its own investigation and punishment;and for all violations of research integrity, it should be responsible for general investigation and punishment.
