摘　　要：《行政诉讼法》自施行以来,城市中“民告官”案件与日俱增,但在广大的农村地区,行政诉讼远未实现立法预期。民间行政争议增多但进入诉讼渠道的案件较少,更多行政相对人直接通过信访乃至采取过激方式促成行政争议的解决。造成农村行政诉讼困境的社会原因是传统农村正从血缘结合、长老统治、村民权利观念淡薄的熟人社会,嬗变为地缘结合、权威丧失、村民权利观念强化的半熟人社会,农村居民由传统的安贫乐道演变为对当下社会的安排日益不满。另外,行政诉讼法是以城市为模型设计的,它在打破了传统农村的行政秩序时,并未建立起现代行政法治新秩序。因此法院应回归到乡土,同时要打破缘法求治的藩篱,积极建构以转型农村为场域的行政诉讼。Since the implementation of the Administrative Procedure Law,the cases of“people suing the government”have been increasing day by day in cities while in the vast rural areas,administrative procedure is far from meeting legislative expectations.The cases of civil administrative disputes are increasing but fewer cases resort to litigation channels.More administrative counterparts directly appeal to higher authorities or even radical methods to settle disputes.This dilemma results from a series of changes in the traditional rural society,including the change from a blood-bonded,elders-ruling,acquittance society with a weak awareness of civil rights to a geo-bonded,authority-disappearing,semi-acquittance society with an increasingly strong awareness of civil rights,and the change from the traditional content to the present growing discontent.In addition,the administrative procedure law is designed with the city as its model.Though it breaks the administrative order of the traditional rural areas,it fails to establish a new legal order.Therefore,the court should play its role in rural areas,and at the same time break the barriers to the rule of law and actively construct administrative procedure that suits the changed rural areas.
