摘 要:近年来,律师调解受到国家大力推动。然而,梳理X基层人民法庭附设律师调解工作室的试点情况,可以发现该模式在实践中尚存调解成功率低、调解员积极性不够、专业化程度不高等问题。归根结底,主要是缺位的管理与考核机制、调解员队伍素质参差不齐、调解激励机制不健全及当事人对律师调解的认可度低所致。健全法院对调解员的管理和考核机制,加强调解员队伍建设,建立有效的律师调解激励机制、并扭转当事人对调解的观念,应为法院附设律师调解工作室制度运行的有效路径。In recent years,lawyer mediation has been strongly promoted by the state.However,combing the pilot situation of the lawyers’mediation studio attached to the X-base People’s Court,we can find that the model still has problems such as low mediation success rate,insufficient mediator enthusiasm,and low degree of specialization.In the final analysis,it is mainly due to the lack of management and assessment mechanism,the uneven quality of the mediator team,the imperfect mediation incentive mechanism and the low degree of recognition of the lawyers for mediation.Improve the court’s management and assessment mechanism for mediators,strengthen the construction of mediators,establish an effective lawyer mediation incentive mechanism,and reverse the parties’concept of mediation.It should be an effective path for the court to set up a lawyer mediation studio system.
