人权概念和人权思想的中国话语阐释

摘　　要：西方人权思想理论是西方历史文化的产物,产生于自身特定的历史文化土壤中,其提供的人权标准和定论对于多元文化的当今世界并不具有绝对普遍意义。对于什么是“人权”和“人权思想”等基本人权理论问题,不能完全按照西方人权理论的既定框架去认识和定论,应从中华几千年历史文化发展的实际出发,坚持把人权的普遍性原则和中华文化传统以及当代实际相结合,运用中国自己的话语对其进行阐释。应当深入发掘、清楚了解先秦以来中华文化蕴含的“以民为本”思想所固有的人权属性及其在系统化、理论化方面所达到的高度,深刻认识其与保障民众生存权、发展权这一基本人权的紧密联系,充分体现“坚持把生存权、发展权作为首要的基本人权”的中国特色人权话语的历史厚重感,有力地增强中国人权话语的说服力和感召力。Traditional Western theories of human rights are products of Western historical and cultural context,whose standards and conclusions are not of absolute universal significance to the multicultural world today.When it comes to the basic issues such as“human rights”and“human rights thoughts”in China,rather than fully duplicating the established framework of Western human rights theories,an illustration with Chinese discourse is needed,with reference to the reality of China’s thousands of years of historical and cultural development,thus combining the universality of human rights with the Chinese cultural tradition and contemporary reality.In-depth exploration and clear understanding of the inherent human rights attribute of the“people-oriented”thought contained in Chinese culture since the pre-Qin period and the height it has reached in systematization and theorization is beneficial to a deep understanding of its close connection with the basic human rights of protecting the people’s right to subsistence and development,a full manifestation of the historical significance of the human rights discourse with Chinese characteristics of“upholding the right to existence and development as the primary basic human rights”,and a strong enhancement of the persuasiveness and appeal of the human rights discourse in China.
