认罪认罚从宽制度下量刑建议规范化研究

摘　　要：通过梳理认罪认罚从宽制度下量刑建议的生成、内容和效力,以厘清当前语境下量刑建议的运行机制和未来发展趋势,对认罪认罚量刑建议规范化运行之障碍进行具体分析,有针对性地提出构建有效的控辩量刑协商机制、提升量刑建议精准度及完善量刑建议监督机制三项对策。In order to clarify the operational mechanism and future development trends of sentencing proposal in the current context,it’s necessary to sort out the generation,content and effect of sentencing proposal under the leniency system on admission of guilty and acceptance of punishment.The obstacles to the smooth operation of the sentencing proposal on admission of guilty and acceptance of punishment are analyzed.Three countermeasures are put forward to construct an effective mechanism of charge and defense sentencing negotiation,improve the precision of sentencing proposal,and perfect the supervision system of sentencing proposal.
