论域分野与内容交融：制度、国际制度与国际法律制度

摘　　要：制度、国际制度与国际法律制度,分别是制度经济学、国际关系学、国际法学中的支撑性概念。制度经济学认为,制度是一切对人的经济行为施加影响的安排。国际关系学认为,国际制度是一个规范相关国际利己主义行为的具有约束力的制度体系。国际法学认为,国际法律制度作为与国内法律制度相对应的概念,是指依靠法律维护国际交往的正常秩序,维护国际和平与正义,促进各国和平合作的发展。在不同理论视野下,三者之间存在内容交融。制度经济学将国际制度作为(国内)制度产生和运行的背景;国际关系学强调国际制度及国际组织运行的经济动因;国际关系学中的国际制度则属国际法学中国际法律制度的一部分。System,international system and international legal system are the supporting concepts in institutional economics,international relations and international law.According to institutional economics,institution is an arrangement that exerts influence on people’s economic behavior.According to the theory of international relations,international system is a binding system to regulate international egoism.According to international law,international legal system,as a concept corresponding to domestic legal system,refers to maintaining the normal order of international exchanges by legal means,maintaining international peace and justice,and promoting the development of peaceful cooperation among countries.In different theoretical perspectives,there is content blending among the three.Institutional economics regards international system as the background of the emergence and operation of(domestic)system.International relations emphasizes the economic motivation of international system and the operation of international organizations.The international system in international relations belongs to a part of the international legal system in international law.
