零工经济中的劳动关系

摘　　要：作为国家战略的共享经济,在稳就业、促增长中发挥着重要作用。共享经济给传统就业方式带来巨大变革,从而催生了零工经济。零工经济产生了与以往不同的用工方式。零工经济劳动者与资方之间的关系成为学界和实务界讨论的热点。国务院办公厅发布《关于促进平台经济规范健康发展的指导意见》,这无疑对我国平台经济的发展注入强心剂。在平台经济下零工经济劳动关系的争论中,除了劳动关系与非劳动关系二元论以外,第三种观点认为应采用更宽容的态度对待平台经济中出现的新用工方式。文章提出应在更长时间周期看待当前零工经济劳动关系,应以更宽广视野接受零工经济劳动关系的多元化。结合发展平台经济需求,提出了零工经济劳动关系的四点思考。As a national strategy,the sharing economy plays an important role in stabilizing employment and promoting growth.Sharing economy has brought tremendous changes to the traditional way of employment,thus giving birth to the gig economy.Under the gig economy,there are different ways of employment.The relationship between workers and employers in the gig economy has become a hot topic in academic and practical circles.The State Council issued Guiding Opinions on Promoting the Healthy Development of Platform Economic.This undoubtedly injects a strong force into the development of China’s platform economy.In the controversy of labor relations in the platform economy,besides the dualism of labor relations and non-labor relations,the third view holds that a more tolerant attitude should be adopted to deal with the new employment patterns in the platform economy.This paper suggests that we should look at the current labor relations in the gig economy in a longer period of time and accept the diversification of labor relations in the gig economy in a broader perspective.Combining with the demand of developing platform economy,this paper puts forward some thoughts on the labor relations of gig economy.
