摘 要:农村房屋买卖关涉到农村宅基地使用权的转让问题,而探讨宅基地使用权的转让对于促进农村经济发展,实现乡村振兴具有重大意义。在司法实践中,农村房屋买卖合同纠纷同案不同判的现象十分突出。同时,该类纠纷案件存在总体不断呈上升趋势、法院立案案由不同、纠纷主体多样以及司法见解存有分歧等特点。究其原因,既有当事人受利益驱动,也有因一户具有多处宅基地,还有缺乏对该类合同效力的认定标准,更有立法上的法律缺位。农村房屋买卖合同纠纷的有效解决,需要明确农村房屋买卖合同效力的认定标准,加强立法工作,完善《土地管理法》相关法律规定。The sale of rural houses involves the transfer of the right to use rural residential land, and the transfer of the right to use the homestead has a major function to promote rural economic development and rural revitalization. In the judicial practice, the phenomenon of different disputes in rural housing sales contract disputes is very prominent. At the same time, disputes in such cases are constantly rising, the court case is different, the disputes are diverse, and the judicial opinions are divided. The reason is that both parties are driven by interests, one household has multiple homesteads, and there is a lack of recognition standards for the validity of such contracts, and there is a legislative vacancy. To effectively solve the disputes over the contract of rural housing sales, it is necessary to clarify the standards for determining the validity of the contract of rural housing sales, strengthen the legislative work, and improve the relevant legal provisions of the Land Management Law.
