摘　　要：党的十八大以来,以习近平同志为核心的党中央高度重视社会主义生态文明建设,坚持把生态文明建设作为统筹推进“五位一体”总体布局的重要内容,坚持节约资源和保护环境的基本国策,坚持绿色发展,把生态文明建设融入经济建设、政治建设、文化建设、社会建设各方面和全过程,加大生态环境保护力度,推动生态文明建设在重点突破中实现整体推进。习近平同志就此发表了一系列重要论述,立意高远,具有重要的指导意义。作为党和国家高度重视环保工作的体现,自进入新时代以来,生活垃圾分类工作受到高度关注。习近平同志于2018年11月在上海调研时将垃圾分类定性为“新时尚”,2019年6月则号召大家培养垃圾分类的好习惯,为绿色发展、可持续发展做贡献。2019年7月1日,伴随着《上海市生活垃圾管理条例》的出台与执行,“垃圾分类”工作以前所未有的曝光度进入公众视野。据学者考证,中国的垃圾分类工作最早可以溯至1957年,那时的垃圾分类是基于“勤俭建国、节约资源”考量而提出的倡议。从1992年开始的垃圾分类地方试点工作,以及后来中央层面的推进工作,则是出于环保价值的考虑。以2017年《生活垃圾分类制度实施方案》的颁布为起点,我国正式进入生活垃圾“强制分类”的时代。与上海一样,为落实2017年《生活垃圾分类制度实施方案》,北京、海南等多地都开始发布地方版本的垃圾分类管理办法或条例。为了深入探讨垃圾分类管理所涉法律问题,在河南社会科学杂志社的组织下,我们约请了中国人民大学王利明教授、武汉大学秦天宝教授、西南政法大学张震教授以及海南大学熊勇先教授、石冠彬教授共同对垃圾分类管理中所涉的立法问题及公众权利保障问题进行研讨,并形成本组笔谈,以期对相关立法的推进和学者的研究提供智识参考。Since the 18th National Congress of the CPC,the Party Central Committee with Comrade Xi Jinping as the core has attached great importance to the construction of socialist ecological civilization,and integrated ecological civilization into economic,political,cultural,and social construction in all aspects and the entire process.Great efforts have been made in the construction of environmental protection to promote the overall advancement of ecological civilization in key breakthroughs.On July 1,2019,with the promulgation and implementation of the Shanghai Municipal Waste Management Regulations,the“garbage classification”work entered the public vision with unprecedented exposure.Starting with the promulgation of the Implementation Scheme for the Classification of Domestic Waste in 2017,China has officially entered the era of“compulsory classification”of domestic waste.Like Shanghai,in order to implement the 2017 Implementation Plan for the Classification of Domestic Garbage,Beijing,Hainan and many other places have begun to publish local versions of garbage classification management methods or regulations.In order to discuss the legal issues involved in this area,under the organization of Henan Social Science Magazine,we invited Professor Wang Liming of Renmin University of China,Professor Qin Tianbao of Wuhan University,Professor Zhang Zhen of Southwest University of Political Science and Law,and Professor Xiong Yongxian of Hainan University to jointly discuss this issue.The related legal issues in the study are discussed,and this group of written discussions is formed,with a view to providing intellectual reference for the advancement of relevant legislation and scholars’research.
