基于认知语用视角的法律隐喻研究

摘　　要：隐喻与哲学的密切关系及哲学的语用学转向,是从认知语用视角分析法律隐喻的可行性基础。结合“法庭是战场”等大量实例说明法律隐喻独特的认知语用特征,即意象性和语境依赖性、体验性和认知差异性、相似性和最佳关联性。借助对法律交际语境和法律认知思维的分析,指出法律隐喻在法律文本中发挥了阐释说明、叙事劝说及推理论证的重要认知语用功能。The close relationship between metaphor and philosophy and the pragmatic turn of philosophy are the feasible basis for analyzing legal metaphor from the perspective of cognitive pragmatics.This paper firstly illustrates the unique cognitive and pragmatic features of legal metaphor,namely imagery and contextual dependency,experience and cognitive differences,similarities and optimal relevance by exemplifications of“the court is the battlefield”and so on.Then,with the analysis of legal communication context and legal cognition thinking modes,it points out that legal metaphor plays important cognitive pragmatic functions in legal texts,such as interpretation and disruption,narration and persuasion,inference and proof.
