食品监管渎职罪主观要件探究

摘  要:食品监管渎职罪是指负有食品安全监管职责的国家机关工作人员,滥用职权或者玩忽职守,导致发生重大食品安全事故或者造成其他严重后果的行为。该罪的主观要件包括犯罪主体和主观罪过,犯罪主体是负有食品安全监督管理职责的国家机关工作人员。食品监管渎职罪分为两种犯罪形式,即滥用职权型的食品监管渎职罪和玩忽职守型的食品监管渎职罪,前者的主观罪过是故意,后者则是过失。The crime of dereliction of duty in food supervision refers to the behavior of the staff members of state organs with the responsibility of supervision over food safety who abuse their power or neglect their duties, resulting in a serious food safety accident or other serious consequences. The subjective elements of the crime include the offender of the crime and fault element. The potential offender of the crime is the staff of state organs responsible for the supervision over food safety. There are two forms of the crime, one is the abuse of supervision power, the other is the dereliction of supervision duty. Among them, the fault element of the former is intention, while that of the latter is negligence.
