摘 要:环境民事公益诉讼的核心问题之一是谁能作为适格的起诉主体。通过对现有环境民事公益诉讼裁判的数据分析,从而发现实践操作中各原告行权的情况及问题。通过梳理原告理论脉络,对环境公共利益进行概念辨析,对国外类似诉讼程序进行比较法分析,认为我国环境民事公益诉讼的起诉主体范围应予扩展,即包括企业法人及公民个人;顺位应予调整,即按照行政机关-环保组织-检察机关-公民个人和其他主体的顺位确定起诉主体序位;同时建立相关配套措施,包括建立预防滥诉惩戒机制,行政机关对于环境民事公益诉讼不作为应当纳入行政诉讼程序,以及环保行政机关应该对环保组织给予资金和专业支持。One of the core issues of environmental public interest litigation is who can be the appropriate subject of litigation.Through the analysis of the data of the existing environmental interest litigation judgments,we can find out the situation and problems of the exercise of the right of each plaintiff in practice.By sorting out the theoretical context of the plaintiff,this paper analyzes the concept of environmental public interest,and makes a comparative analysis of similar proceedings abroad.The ranking should be adjusted,that is,the ranking of the prosecution subjects should be determined according to the ranking of administrative organs-----environmental protection organizations-----procuratorial organs----citizens and other subjects.At the same time,relevant supporting measures should be established,including the establishment of disciplinary mechanism to prevent abuse of litigation,the omission of administrative authorities in civil environmental public interest litigation should be included in administrative proceedings,and the environmental protection administrative authorities should provide financial and professional support to environmental protection organizations.
