论外商投资企业投诉工作机制的不足与完善

摘　　要：外商投资企业投诉工作机制是我国为吸引外资而设立的制度。自改革开放以来,该制度的基本框架主要由商务部和各省市出台的相关办法构建。但是,在缺乏更高层级立法指导的情形下,上述制度框架存在立法内容不统一、机构设置不规范、人员设置不明确等缺陷。《中华人民共和国外商投资法》第26条首次在法律层面明确建立外商投资企业投诉工作机制,为切实有效运行该机制,应以先前外商投资企业投诉工作机制基本框架为基础,统一实体法和程序法内容,完善相关机构的层级设置以及受理范围规定,并明确投诉工作人员的构成和选任标准,充分发挥该机制在增强外资保护、改善投资软环境和吸引外资等方面的积极作用。The complaint mechanism of foreign-invested enterprises is a mechanism that was built to attract foreign investment.Since the opening-up of our country,that system’s basic framework has been established by the Ministry of Commerce,other provinces and municipalities according to relevant measures.Because of lacking legislative guidance at a higher level,that institutional framework includes some defects,such as inconsistent legislative content,lack of standardization in institutions setting,unclear staff setting and so on.The Article 26 of Foreign Investment Law of the People’s Republic of China clearly stipulated the complaint mechanism of foreign-invested enterprises for the first time.To effectively operate the mochanism,we should unify the contents of substantive and procedural law and perfect the hierarchy establishment and its acceptability of cases scope.In addition,we also should make the personnel setting and recruiting standard clearly.And all above measures should be taken on the basic of previous framework of the Complaint mechanism of foreign-invested enterprises.Only in this way can we ensure that system will really work in enhancing the protection of foreign capital,improving the soft investment environment,attracting foreign investment and so on.
