民族地区横向生态转移支付的法治化构建——以广西金秀瑶族自治县为例

摘　　要：横向生态转移支付法治化意味着标准的制度化、行为的规范化、权利义务设计的合理化以及监管的常态化。外部性及公共物品和公共资源理论、法治理论、民族发展理论是民族地区与受益地区横向生态转移支付法治化构建的理论基础,通过法律关系主体的确定、权利义务的设计、法律责任的安排,将横向生态转移支付纳入法治化的轨道,能够充分保障民族地区重要生态功能区所获得的资金支持随着所提供的生态服务质量的提高、数量的增加而持续稳定增长,能够更好地解决新时期民族地区“不平衡不充分发展问题”,对于发展民族经济、巩固边疆、加强民族团结和铸牢中华民族共同体意识意义深远。The legalization of horizontally ecological transfer payment signifies the institutional ization of criterions,the standardization of behaviors,the rationalization of rights and obligations,and the normalization of supervision.Externalities and public goods and theories of public resources,law theories,ethnicity development theories are the theoretical bases of legal construction of horizon tally ecological transfer payment in ethnic areas and beneficiary areas.Through confirming the sub jects of legal relations,designing rights and obligations,and arranging legal responsibilities,horizon tally ecological transfer payment will be directed into the orbit of legalization,which can ensure the increase of acquired funds accompanying the increase of quality and quantity of ecological services in those important ecological function-zone in ethnic areas.As well,it can solve the problem of un balanced and inadequate development in ethnic areas in the new eras,producing profound impacts on developing ethnic economy,strengthening national unity and enhancing community awareness of the Chinese nation.
