摘 要:用人单位的用工自主权主要体现在对劳动合同的单方变更。我国《劳动法》《劳动合同法》仅确立劳动合同协商变更的原则,对用人单位单方变更权的立法缺失,引致司法实践中各法院对用工自主权的理解不一,同案不同判的情形大量存在。为减少各地裁判乱象,平衡用人单位经营管理自主权与劳动者利益保护,宜从用工自主权行使基础以及用工自主权行使的正当性两方面出发考察用人单位单方变更劳动合同的合法性与合理性。The autonomy of employment is mainly embodied in the unilateral change of labor contract by the employer.The labor law and labor contract law in our country only establish the principle of change in the labor contract negotiation,and are lack of legislation on employer's unilateral right to change.This leads to different explanations on the autonomy of employers by the court in judicial practice,which causes different judgment on the same case.In order to reduce the confusion of judgment in different regions and balance the management autonomy of employers with the protection of the labors’interests,it is appropriate to investigate the legality and rationality of the employer's unilateral modification of the labor contract from the two aspects of the basis and legitimacy of exercising the autonomy of employment.
