摘 要:简述环境行政公益诉讼诉前程序被视为与诉讼程序同等重要的制度创新,整体上呈现出积极发展的趋势,在理解其基本理论的基础上发掘实践中出现的问题,对于行政机关的行政处理行为,检察机关方面应当给予充分的尊重,并树立行政处理优先的原则,以此来调动行政机关的主观能动性,在新形势下检察建议也应当在法定形式、期限设置、履职界限等方面做出合理变革,最大限度地让环境公共利益不再受到二次损害。The paper briefly introduces that the pre-litigation procedure is regarded as an equally important system innovation with the litigation procedure.On the whole,the pre-litigation procedure of environmental administrative public interest litigation shows a positive development trend.The existing problems in the practice are explored on the basis of understanding the basic theory.For the administrative handling behavior of the administrative organ,the procuratorial organ should show full respect,and establish the principle of administrative priority,so as to mobilize the subjective initiative of the administrative organ.In the new situation,procuratorial construction should also reasonably change in terms of the legal form,time limit setting,performance boundary and so on,thus preventing the environmental public interest from secondary damage to the maximum extent.
