摘  要:2018年最高人民法院发布的《行诉解释》新增了投诉举报人具有原告资格的情形,但在受案范围中并未明确行政投诉举报答复行为的可诉性,致使目前司法实践中对其可诉性产生了不同的认识。传统行政行为类型化理论在投诉举报答复行为可诉性的认识上具有静态化、片段化的缺点。因此,在明确可诉性标准的基础上,通过行政过程理论对投诉举报答复行为进行全面、动态的考察,并根据行政过程理论将答复行为作出的过程划分为受理阶段、处理阶段以及特殊阶段三个不同阶段,以此厘清各阶段答复行为的具体可诉类型。The judicial interpretation of administrative procedure law issued by the Supreme People's Court of 2018 added the situation that the complainant and reporter have the qualification of plaintiff,but the justifiability of the reply to the complaint and report is not clear in the scope of accepting the case,resulting in different understandings of its justifiability in the current judicial practice.The traditional theory of administrative act classification has the shortcomings of static and fragmentary in the understanding of the litigable nature of the reply to the complaint and report.Therefore,on the basis of defining the standards of justifiability,it is to make a comprehensive and dynamic investigation on the reply to the complaint and report through the theory of administrative process.According to the administrative process,the response process can be divided into three different stages:acceptance stage,processing stage and special stage,so as to clarify the specific types of justifiability in each stage.
