民族地区巡回审判法庭建设的“平武模式”

摘　　要：课题组对民族地区平武法院最近5年的涉环境资源刑事案件作了一个调研,即通过描绘平武法院2012-2016年案件数、刑事案件数、环境资源案件数情况展示环境资源刑事案件在刑事案件、法院案件两道背景中的基本现状、发展态势。调研显示:其间平武法院总体案件、刑事案件保持平稳(略有增加),而环境资源刑事案件已发展为非常重要的一类刑事案件,相较于绵阳市其他法院更是一类非常有特色的刑事案件。通过统计、整理法院案件数据,剖析典型案例,获得以下认知:平武法院在审理环境资源刑事案件过程中涉及到的审判组织、审判人员知识储备和法律技术的掌握等问题上具有独特实践,其建立的"环境资源(与旅游)巡回审判法庭"特色鲜明,与最高人民法院设立的巡回审判法庭形成了值得研究的对比。The research group conducted a survey on the past-five-year criminal cases related to environmental resources judged by Pingwu county court which is located in ethnic area, including the number of criminal cases, criminal cases and environmental resources cases from 2012 to 2016, so as to reveal the basic status quo and development trend of criminal cases related to environmental resources in the context of criminal cases and court cases. The result shows that the overall cases and criminal cases remain stable(with a slight increase), while the environmental and resource criminal cases have developed into a very important criminal case, which is more of a unique criminal case compared with other courts in Mianyang city. It is known from the analysis of case statistics and typical cases that Pingwu county court holds unique practical experience in handling criminal cases related to environmental resources, such as judicial organization, or judicial personnel with knowledge reservation and master of legal techniques.It is worthwhile to make a comparative study between the environmental resources(and tourism) circuit court with distinctive features and circuit court set up by the Supreme People’s Court.
