我国公立大学职务科技成果权属分置制度的困境与完善

摘　　要：职务科技成果权属分置制度的实施,旨在提高我国职务科技成果的转化率,然而由于知识产权归属制度不尽科学合理、科技成果处置路径存在局限性、科研人员奖酬机制失调,以及政府规制中存在的制度设计缺陷,该制度实施后并未达到预想中的效果。完善职务科技成果权属分制制度,发挥利益引导功能,是当前提高我国职务科技成果转化率、促进科学研究与产业经济相融合的当务之急。The implementation of the ownership division system of scientific and technological achievements aims to improve China’s conversion rate of the post scientific and technological achievements.However,due to the system of intellectual property ownership is not scientific and reasonable,the disposal of the path of scientific and technological achievements is limited,the reward mechanism of researchers is disorders and the defects of system design in government regulation,the system has not reached the expected effect after implementation.It is urgent to improve the ownership division system of scientific and technological achievements,give full play to the function of benefit guidance to improve the conversion rate of the post scientific and technological achievements,and promote the integration of scientific research and industrial economy.
