摘 要:我国生态损害的救济呈现出多元化的趋势,且以私法手段为主导,不同救济手段间缺乏协调。对不同救济方式的特点和局限性的分析显示,我国应采用以公法救济为主导、私法救济为补充的复合救济模式。公法救济与私法救济衔接问题实际上是不同主体提起此类民事诉讼的顺位问题。在分析多元化救济手段的基础上,对生态损害救济体系的重构提出建议,应从明确公私法救济手段的适用关系及对行政救济不力时补救措施的建立入手。A variety of methods coexist in remediating ecological damage in China,which are dominated by private law approaches.The lack of coordination between varies methods also attracted broad academic attention.According to the analysis of the characteristics and limitations of different relief methods,a mixed mode should be adopted,dominated by public law approach and supplemented by private law approaches.The coordination between them is actually the order of different subjects to bring such civil litigations.Based on the analysis of diversified relief methods,suggestions were put forward for the reconstruction of the relief system for ecological damage,starting with clarifying the applicable relationship of public and private law relief methods and the establishment of remedial measures when administrative relief is ineffective.
