谋职假之法律问题探讨——兼论《劳动合同法》第四十条之规定与完善

摘  要:谋职假制度是解雇保护制度的重要组成部分,被纳入劳动基准而强制适用。设置谋职假制度的目的是为了平衡预告解雇期间劳工工作与求职的时间冲突,帮助劳动者在预告解雇期间届满能顺利实现重新就业。劳工申请谋职假期间视为正常出勤,并有权获得正常工资。我国《劳动合同法》设立代通金制度能够部分弥补未设立谋职假制度的不足,但是这种立法方式并不可取,建议在未来修法时取消代通金制度,设立谋职假制度,并对请假时间、工资支付和请假程序做出明确具体规定。Job-seeking leave is a part of the dismissal protection system,and it is forced to apply as the labor standards act.The purpose to establish the job-seeking leave is to balance time conflict between the job and job-seeking during the notice of dismissal,help the workers successfully achieve re-employment in advance of the termination of employment contract.The period when the worker applies for job-seeking leave shall be regarded as normal attendance and be entitled to regular pay.The labor contract law of our country sets up the payment in lieu of dismissal notice can some make up for the absence of a job-seeking leave system,but this kind of legislative way is not a good way.It is proposed to abolish the payment in lieu of dismissal notice in the future revision of the labor contract law and to establish the job-seeking leave system,and make specific provisions about the leave time,wage payment and the leave procedures.
