法律与伦理视野下患者知情同意权的保护——基于长沙徐女士与某美容医院因术前未做孕检纠纷一案

摘　　要：通过分析长沙徐女士怒斥某美容医院在为其做整形美容手术前未做孕检一案,反映出我国医疗领域中保护患者知情同意权方面普遍存在漏洞。患者的知情同意权是医患关系的重要内容,也往往是医患纠纷产生的主要原因。要改善医患关系,从而减少医患纠纷,从法律与伦理角度来保护患者知情同意权,首先,将患者知情同意伦理原则规范优先入法;其次,努力推进知情同意法律与伦理建设有机结合;最后,做好医疗人性化的全方位顶层设计。在临床实践中,有效的落实好患者知情同意,对于医患都能够得到很好的保护,也可以避免、缓解并减少医疗纠纷,是改善医患关系的一剂良药,对改善医患关系有着十分重要的现实意义。Through the analysis of the case that Ms.Xu from Changsha denounced one beauty cosmetic hospital due to the lack of pre-operation pregnancy examination,it reflected that there were widespread loopholes in protecting patients’informed consent right to in the medical field in China.Patients’informed consent right is an important part of the doctor-patient relationship,and it is often the main cause of doctor-patient disputes.To improve the doctor-patient relationship,reduce doctor-patient disputes and protect patients’informed consent right from the perspective of law and ethics,firstly,the ethical principles of informed consent should be given priority to the law;secondly,efforts should be made to promote the organic combination of informed consent law and ethical construction;finally,a comprehensive top-level design of medical humanization should be done.In clinical practice,effective implementation of patients’informed consent can well protect doctors and patients.It can avoid,alleviate and reduce medical disputes.It is a good medicine to improve the doctor-patient relationship,and has very important practical significance to improve the doctor-patient relationship.
