检察环节适用认罪认罚从宽制度的内涵阐释与推进路径

摘　　要：刑事诉讼法中确立认罪认罚从宽制度,具有厘清认罪认罚从宽法律适用关系和丰富刑事诉讼司法模式的制度价值。认罪认罚从宽制度通过参与量刑协商,体现公平正义并提升刑事诉讼效率。"两高三部"制定的《关于适用认罪认罚从宽制度的指导意见》进一步阐明了制度的适用范围、适用条件和理解适用等问题,明确解决了法律适用中的疑难问题。但目前各地检察机关仍面临制度适用不均衡的问题。以认罪认罚从宽制度的适用为切入点,从新时代检察工作创新的理念出发,准确理解检察机关在认罪认罚从宽制度中的主导作用和主导地位,有助于提升新时代检察机关参与社会治理的能力和水平。Establishing the leniency system of pleading guilty and punishment in the Criminal Procedure Law has the institutional value of clarifying the legal application of leniency system of pleading guilty and punishment and enriching the judicial model of criminal litigation. The leniency system of pleading guilty and punishment reflects fairness and justice and improves the efficiency of criminal proceedings by participating in sentencing negotiations. The "Guiding Opinions on the Application of the Leniency System of Pleading Guilty and Punishment"formulated by the Tw o Highs and Three Departments further clarified the scope of application,applicable conditions and understanding application of the system,and clearly solved the difficult problems in the application of the law. How ever,at present,local procuratorates still face the problem of uneven application of the system. Taking the application of the leniency system of pleading guilty and punishment as an entry point,starting from the innovative concept of procuratorial w ork in the new era,and accurately understanding the leading role and leading position of the procuratorial organ in the leniency system of pleading guilty and punishment w ill help enhance the ability and level of procuratorial organs to participate in social governance in the new era.
