空白罪状视域下利用未公开信息交易罪研析

摘　　要：2019年7月,关于利用未公开信息交易罪最新的司法解释正式开始实施,该司法解释对利用未公开信息交易罪中一直有争议的问题做出了一定程度的说明,但关于"违反规定"这一空白罪状范围的解释却存在不尽合理之处。利用未公开信息交易罪具有行政犯属性,需要以行政规范为判断前提,为了避免行政违法行为犯罪化趋势的扩张,或以行政处罚代替刑事处罚,应在不违反罪刑法定原则的前提下,发挥空白罪状的界分功能,通过对空白罪状中行政规范的合理界定,厘清行政违法与刑事违法的关系,做出实质性的刑事违法判断,进而在法秩序统一的前提下,保持刑法独立性。The latest judicial interpretation of the crime of trading on undisclosed information was officially implemented in July 2019. It explains some controversial issues concerning the crime of trading on undisclosed information,but its interpretation of the " violation of provisions" is not reasonable. The crime in question belongs to administrative offense,and thus should be judged by administrative norms in the first place. In order to stop the rise in the amount of administrative crime or a replacement of criminal punishment with administrative punishment,we should,under the principle of legality,activate the function of the blank description of crime in distinguishing the administrative from criminal illegality and make substantive criminal convictions,thereby maintaining the independence of the criminal law within the legal order.
