摘 要:文明转型视角下,中华法系有"转型说"与"复活说"两种。两说之别蕴含着农耕文明向商工文明转型的文明与文化之辨。中华法系既是华夏农耕文明的产物,也是传统文化的制度载体。论证中华法系复兴思路,应直面文明与文化之间的张力,把握文明转型的社会动力、结构、语境,识别文化在文明转型中的历史方位、功能、价值,在中西方比较的语境中厘清中华文明、文化、法系三者之间的关系,澄明中华法系复兴的学理依据。From the perspective of civilization transformation,there are two kinds of theories in Chinese legal system:transformation theory and resurrection theory.The difference between the two theories implies a debate between civilization and culture in the transition from farming civilization to commercial and industrial civilization.The Chinese legal system is not only the product of Chinese farming civilization,but also the institutional carrier of traditional culture.To demonstrate the idea of reviving the Chinese legal system,we should face the tension between civilization and culture,grasp the social motive force,structure and context of civilization transformation,identify the historical position,function and value of culture in civilization transformation,clarify the relationship among Chinese civilization,culture and legal system in the context of comparison between China and the West,and clarify the theoretical basis for the revival of the Chinese legal system.
