摘  要:对基于CLC92《国际油污赔偿公约》的IMO/UNEP《海洋溢油环境损害评估指南》与美国《自然资源损害评价》(NRDA)进行对比,主要分析其研究背景、环境损害评估内容、评估流程、评估方法的不同,并以欧洲Erika溢油事故和美国墨西哥湾事故损害评估为例,论证IMO指南提出的损害和环境恢复的内涵、损害评估的方法,以及恢复措施的执行等方面与NRDA的不同点。The IMO/UNEP Guidance Manual on the Assessment and Restoration of Environmental Damage following marine oil spills based on the CLC92 was compared with the American Natural Resources Damage Assessment(NRDS)based on oil pollution act of America,including the difference of research background,content,process and method of damage assessment.Taking Erika oil spill accident in Europe and damage assessment of Mexico gulf accident in the United States as examples,the differences between the connotation of damage and environmental recovery,the method of damage assessment and the implementation of recovery measures proposed by IMO guidelines and NRDA were investigated.
