摘 要:血亲复仇并非中国的独有现象,但却因家国文化、儒家孝仁思想、侠义之风等在中国有着深厚的文化土壤。汉唐时期的立法除短暂施行的《轻侮法》外,虽然对血亲复仇严令禁止,但在"以孝治天下"和强调"德礼为政教之本,刑罚为政教之用"的政策下,实践中出现了曲法为情和合法悖情两种不同处理方案。以史为鉴,当下应当以司法公信力建设为核心,加强司法公开与论证说理,建立被害人心理疏导机制,从而深化公民法治信仰,营造法治文化氛围,从文化根源上防范血亲复仇案件的发生。Blood revenge is not a unique phenomenon in China,but it has a profound cultural soil in China because of family culture,Confucian filial piety and benevolence,chivalrous style and so on.In the Han and Tang dynasties,although it was strictly prohibited,under the policy of"governing the world with filial piety"and emphasizing that"virtue and etiquette is the foundation of politics and education,and punishment is the use of politics and education",in practice,there are different verdicts in the case of blood revenge.Taking history as a mirror,we should take the construction of judicial credibility as the core,strengthen judicial openness and reasoning,and establish a psychological counseling mechanism for victims,so as to deepen citizens’belief in the rule of law,create a cultural atmosphere of the rule of law,and prevent it from the cultural roots.
