临床医生参加医疗纠纷司法鉴定会的常见问题探析

摘　　要：应用德尔菲法对经常参加医疗纠纷司法鉴定会的鉴定专家进行访谈,收集其认为的临床医生在参加医疗纠纷司法鉴定会时经常出现的共性问题,进行归纳总结。研究发现,临床医生参加医疗纠纷司法鉴定会中的主要问题:参加鉴定会的临床医生级别偏低,对病历整体性掌握不到位,对诊疗行为的合理性不能给出书面证据支持,现场陈述内容与病历记载不符,误解知情同意书的作用,一味强调不良后果是并发症,夸大所在医疗机构的诊疗能力,以及不敢或不屑于承认医疗措施的局限性。This article collects and summarizes common problems that the clinicians often encounter when they participate in judicial appraisal meeting of medical dispute by using Delphi method to interview attendant experts.Main problems show in the study include lesser understanding to the integrity of medical record,absent written evidence to the rationality of the diagnosis and treatment,inconsistent contents of the on-site statement with the medical record,misunderstanding to informed consent,overemphasis to complications,exaggeration of diagnosis and treatment ability,and fear or disdain to recognize the limitations of medical measures.
