国家所有权视角下海域资源管理法制生态化探析

摘　　要：海域资源在中国作为全民所有的自然资源,亟待构建既尊重市场规律,又适应生态文明建设要求的生态化、法治化管理制度。海域国家所有权是政府依法管理海域资源的重要理论基础与基本法律框架,具有客体生态性、主体抽象性与内容复合性等特征,并对海域资源管理法制提出了生态化要求。海域资源管理生态化实践中出现"政府失灵"问题,主要原因在于政府行使海域国家所有权时未能遵循海域国家所有权在客体、主体与内容方面的生态化要求。对此,应基于海域国家所有权的特征与要求,从法律价值理念、管理权限配置与法律实施机制等方面逐步提高海域资源管理法制的生态化水平,从而实现满足海洋经济高质量发展和海洋生态环境保护双重要求的生态化目标。Since sea area resource is a kind of marine resources owned by the state in China,it is urgent to build an ecological and legalized management system that is based on market mechanisms and meets the needs of ecological civilization construction.The state ownership of sea area is an important theoretical basis and legal framework for the government to manage sea area resources in accordance with the law,which is characterized by ecology object,abstract subject and complex contents,posing unique ecological requirements for the legal system of sea area resource management.The problem of"government failure"in the ecologicalization of sea area resource management is mainly due to the failure of the government to comply with the ecological requirements of sea area state ownership in terms of its object,subject and contents.In this regard,based on the specific characteristics and requirements of sea area state ownership,it is necessary to improve the legal value,management competence distribution,and legal implementation mechanisms of the legal system for sea area resource management,so as to gradually improve its ecological level,thus achieve the ecological goal of meeting the dual requirements of high-quality development of marine economy and marine ecological environmental protection.
